NOMM TERMS OF SERVICE

1. Introduction
Welcome to NOMM ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the NOMM waitlist and website at nommsocial.com (collectively, the "Service").
By joining our waitlist or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
2. Eligibility
You must be at least 13 years old (or 16 in the EEA) to join the NOMM waitlist. By joining, you represent and warrant that you meet this age requirement.
3. Waitlist Purpose and Limitations
3.1 What the Waitlist Is
The NOMM waitlist allows you to register your interest in being notified when the NOMM platform launches.
3.2 What the Waitlist Is NOT
Joining the waitlist does NOT guarantee:
Access to the NOMM platform when it launches
Early access or priority access
A specific launch date or timeline
Platform ownership, equity, or revenue sharing (these will only be available to active users after platform launch and participation)
Any specific features or functionality apart from what features that NOMM will provide as standard.
3.3 No Binding Commitment
Waitlist registration creates no contractual obligation on either party. You may leave the waitlist at any time by unsubscribing. We may remove users from the waitlist at our sole discretion.
4. Account Information
4.1 Accurate Information
You agree to provide accurate, current, and complete information when joining the waitlist. You are responsible for maintaining the accuracy of your information.
4.2 Email Communications
By joining the waitlist, you consent to receive emails from us regarding NOMM's development, launch, and related updates. You may unsubscribe at any time using the link provided in our emails.
5. Platform Development and Changes
5.1 Subject to Change
NOMM is currently in development. All features, functionality, business model, timeline, and other aspects of the platform are subject to change without notice. Information shared during the development phase is not final and may be modified before launch.
5.2 No Guarantees
We make no guarantees regarding:
The final features or functionality of NOMM
The platform's business model or revenue-sharing structure
Launch timeline or availability
Compatibility with any devices or platforms
6. Intellectual Property
6.1 Ownership
All content, branding, designs, logos, text, graphics, and other materials related to NOMM and the Service are owned by NOMM or its licensors and are protected by intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose (joining the waitlist). You may not copy, modify, distribute, or create derivative works based on our content.
6.3 No Ownership Claims
Waitlist members have no ownership, equity, or intellectual property rights in NOMM unless formally granted through separate agreements after platform launch.
7. Prohibited Conduct
You agree NOT to:
Provide false or misleading information
Use the Service for any unlawful purpose
Attempt to gain unauthorized access to our systems
Use automated tools (bots, scrapers) to access the Service
Interfere with or disrupt the Service
Violate any applicable laws or regulations
Infringe on others' intellectual property or privacy rights
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your data.
9. Disclaimers
9.1 "AS IS" Basis
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 No Guarantees
We do not warrant that:
The Service will be uninterrupted, secure, or error-free
Any information provided will be accurate or complete
NOMM will launch on any specific date or at all
The platform will have any specific features or functionality
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
Your use of or inability to use the Service
Any delays, changes, or cancellation of the NOMM platform launch
Any errors or omissions in the Service
Any unauthorized access to or use of our servers or your personal information
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED £100 (ONE HUNDRED POUNDS STERLING).
11. Indemnification
You agree to indemnify, defend, and hold harmless NOMM and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Any information you submit through the Service
12. Termination
12.1 By You
You may stop using the Service and unsubscribe from the waitlist at any time.
12.2 By Us
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
12.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
13. Modifications to Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
Material changes will be communicated via email where reasonably practicable.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
14.2 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts of England and Wales for resolution of any disputes arising from these Terms or the Service.
14.3 Informal Resolution
Before filing any formal claim, you agree to contact us at legal@nommsocial.com to attempt to resolve the dispute informally.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NOMM regarding the Service and supersede any prior agreements.
17. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
